Dominican Rep. wins lawsuit over national park in highlands
Santo Domingo.- The Dominican State emerged victorious in international arbitration as a result of the lawsuit filed by Michael and Lisa Ballantine.
The lawsuit was filed on the basis of Chapter 10 on Investment of the Dominican Republic-Central America-United States Free Trade Agreement (DR-CAFTA), in particular the provision on National Treatment, Most Favored Nation Treatment, Minimum Level of Treatment and Expropriation.
The Ballantines had sued the State for US$41.5 million over the property “Jamaca de Dios,” alleging violations of DR-CAFTA for not allowing him to expand his housing and recreational project in the protected area of Baiguate National Park.
